The Queen v. O. (T.) 2017 (Provincial Court of Alberta)
The client was pulled over for having no mud flaps close to the town of Lake Louise on the Trans Canada Highway. The police officer made certain observations that led him to suspect the client was in possession of drugs. He detained the client for a drug investigation and soon later arrested the client. Upon searching the truck the officer found a sizable amount of marihuana. The client was charged with possession for the purposes of traffickng. Two months before the trial Mr. van der Walle filed his Notice of Constitutional Argument alleging that the police officer violated the client’s rights in numerous ways. On the morning of trial the prosecutor formally withdrew the charge. No trial necessary. Not guilty.
